1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Fursure Cleanup ("Company," "we," "us," or "our") governing your use of our website at www.fursure.services and all dog waste removal and related services we provide.

By accessing our website, requesting a quote, signing up for service, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or services.

You represent that you are at least 18 years of age and have the legal authority to enter into this agreement. If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Service Description

Fursure Cleanup provides professional dog waste removal and related yard maintenance services, including:

  • Weekly Dog Waste Removal: Scheduled once-per-week cleanup of dog waste from your yard.
  • Bi-Weekly Dog Waste Removal: Scheduled twice-per-month cleanup of dog waste from your yard.
  • Monthly Dog Waste Removal: Scheduled once-per-month cleanup of dog waste from your yard.
  • One-Time Cleanup: A single, thorough cleanup of accumulated dog waste.
  • Kennel-Grade Disinfection: Application of kennel-grade disinfectant to sanitize and deodorize your yard.
  • Commercial Services: Dog waste removal for HOAs, apartment communities, commercial properties, and pet waste station installation and maintenance.

Service visits include the removal of dog waste from accessible areas of your yard. We will bag and dispose of all collected waste. We do not remove waste from indoor areas, garages, or non-yard surfaces unless specifically arranged in advance.

3. Service Area

Fursure Cleanup currently provides services throughout the Mississippi Gulf Coast, specifically in:

  • Harrison County, MS — including Biloxi, Gulfport, Long Beach, D'Iberville, and surrounding areas
  • Jackson County, MS — including Pascagoula, Ocean Springs, Gautier, Moss Point, and surrounding areas
  • Hancock County, MS — including Bay St. Louis, Waveland, Diamondhead, and surrounding areas

Service availability is determined by zip code. You can verify whether your address is within our service area by using the instant quote calculator on our website or by contacting us directly. We reserve the right to modify our service area at any time.

If your address falls outside our current service area, you may submit your information to be notified when we expand coverage to your location.

4. Pricing and Payments

Pricing

Service pricing is based on the number of dogs on your property and the selected service frequency. Quotes provided through our website or by our team are estimates. Final pricing may vary based on yard size, property conditions, and specific service requirements.

We reserve the right to adjust pricing with reasonable notice. For subscription customers, any pricing changes will take effect at the start of the next billing cycle with at least 14 days' prior written notice.

Initial Cleanup Fee

New customers may be subject to an initial cleanup fee to address any accumulated waste before beginning regular service. This fee will be communicated and agreed upon before service begins.

Payment Terms

  • Payment is due as specified in your service agreement or invoice.
  • We accept payments processed through Stripe, including major credit and debit cards.
  • Subscription services are billed on a recurring monthly basis.
  • All prices are quoted in U.S. dollars (USD).

Late Payments

If payment is not received by the due date, we may suspend services until the account is brought current. Accounts that remain unpaid for more than 30 days may be subject to cancellation. We reserve the right to charge a late fee on overdue balances.

5. Scheduling and Property Access

Service Schedule

Service visits are performed on the scheduled day during normal business hours. While we make every effort to maintain consistent scheduling, service times may vary due to route optimization, weather, or other factors. We do not guarantee a specific time of day for service.

Property Access

You are responsible for ensuring that our service technicians can access your yard on scheduled service days. This includes:

  • Gate Access: All gates must be unlocked or accessible on service days. If you have a combination lock or code-operated gate, you must provide the current access code to us in advance.
  • Clear Pathways: Pathways to and within the yard must be clear of obstructions that could prevent safe access.
  • Notification of Changes: If gate codes, locks, or access methods change, you must notify us promptly.

Locked Gate Policy

If our technician is unable to access your yard due to a locked gate, blocked entry, or other access issue, the visit will be marked as a "locked gate" service call. You will still be charged for the visit, as our technician traveled to your property and allocated service time. We will make reasonable attempts to notify you if we cannot gain access.

6. Service Conditions

Weather Cancellations

In the event of severe weather (heavy rain, thunderstorms, flooding, hurricanes, tropical storms, or other hazardous conditions), we may postpone service. We will make reasonable efforts to reschedule affected visits within the same billing period. You will not be charged for services that are cancelled due to weather and not rescheduled.

Holidays

We may observe certain holidays during which service will not be provided. Holiday schedules will be communicated in advance when possible. Service missed due to a holiday will be rescheduled or credited at our discretion.

Unsafe Property Conditions

Our technicians reserve the right to skip service if they encounter unsafe conditions on your property, including but not limited to: standing water, hazardous chemicals, broken glass, aggressive wildlife, construction hazards, or any situation that poses a safety risk. You will be notified if service is skipped due to unsafe conditions.

7. Customer Responsibilities

As a customer of Fursure Cleanup, you agree to:

  • Provide Accurate Information: Ensure that all information you provide (address, number of dogs, contact details, gate access instructions) is accurate and up to date.
  • Maintain Yard Access: Keep gates unlocked and pathways clear on scheduled service days.
  • Notify Us of Changes: Promptly inform us of any changes to the number of dogs on your property, gate codes, contact information, or any other details that affect service delivery.
  • Secure Aggressive Animals: If you have a dog or other animal that may be aggressive toward our technicians, you must secure the animal indoors or in a separate area before your scheduled service. See Section 8 for our pet safety policy.
  • Pay Promptly: Make timely payments for all services as agreed.
  • Disclose Hazards: Inform us of any known hazards on your property (chemicals, holes, construction, etc.) that could affect technician safety.

8. Pet Safety and Interaction

We understand that dogs are family members, and we take their safety seriously. Please note the following policies:

  • Dogs in the Yard: Our technicians can perform service while dogs are present in the yard, provided the dogs are non-aggressive and do not interfere with service. However, for the safety of both our staff and your pets, we recommend keeping dogs indoors during service visits.
  • Aggressive Dog Policy: If a dog displays aggressive behavior toward our technician (growling, lunging, snapping, or biting), the technician will leave the property immediately and the visit will be marked as a locked-gate call. Repeated aggression incidents may result in service suspension or termination.
  • Gate Responsibility: Our technicians will close and secure all gates behind them upon entering and leaving your property. However, Fursure Cleanup is not liable for pets that escape due to pre-existing gate defects, damaged fencing, or situations beyond our reasonable control.
  • No Veterinary Services: Our technicians are not veterinarians. If our team observes concerning signs in your yard (such as evidence of illness in waste), we may inform you as a courtesy, but this does not constitute veterinary advice.

9. Subscription Services

If you enroll in a recurring service plan (weekly, bi-weekly, or monthly), the following terms apply:

  • Recurring Billing: Your subscription will be billed automatically on a monthly basis at the agreed-upon rate until cancelled.
  • Service Continuity: Your subscription will continue from month to month unless you cancel in accordance with Section 10.
  • Service Pauses: You may request a temporary pause of your subscription (e.g., for vacation or extended absence) by contacting us at least 48 hours in advance. Paused service will not be billed. Pauses are subject to approval and availability upon resumption.
  • Frequency Changes: You may request a change in service frequency by contacting us. Changes will take effect at the start of the next billing cycle.
  • Dog Count Changes: If the number of dogs on your property changes, you must notify us so we can adjust your pricing accordingly.

10. Cancellation and Refunds

How to Cancel

You may cancel your service at any time by contacting us via phone at 228.432.4249 or email at info@fursure.services. We request at least 48 hours' notice before your next scheduled service to avoid being charged for that visit.

Refund Policy

  • Services already rendered are non-refundable.
  • If you cancel mid-billing cycle, you will receive a prorated credit for any unused, scheduled visits remaining in that billing period.
  • Initial cleanup fees are non-refundable once the initial service has been performed.
  • Refunds, when applicable, will be processed to the original payment method within 5–10 business days.

Cancellation by Fursure Cleanup

We reserve the right to cancel or suspend your service for any of the following reasons:

  • Non-payment or repeated late payments
  • Repeated locked-gate or inaccessible-property incidents
  • Aggressive animal encounters that endanger our staff
  • Unsafe property conditions
  • Abusive or threatening behavior toward our team members
  • Breach of these Terms

11. Liability and Disclaimers

Property Damage

Fursure Cleanup will take reasonable care when performing services on your property. In the unlikely event that our team causes damage to your property, please notify us within 48 hours. We will investigate the claim and, if damage is confirmed to be caused by our team, work with you to resolve the issue fairly.

Pre-Existing Conditions

We are not responsible for pre-existing property conditions, including but not limited to: dead or dying grass, holes in the yard, erosion, pest infestations, or damage caused by your pets. Dog waste itself can cause lawn damage over time, and our removal of waste may reveal underlying damage that was previously hidden.

Limitation of Liability

To the fullest extent permitted by Mississippi law, Fursure Cleanup's total liability for any claims arising from our services shall not exceed the amount you paid for services in the three (3) months immediately preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

No Guarantees

While our services significantly reduce pet waste and associated odors, we do not guarantee the complete elimination of pests, odors, or bacteria from your yard. Our kennel-grade disinfection service is designed to reduce bacteria and odor but is not a substitute for professional pest control or veterinary treatment.

Force Majeure

Fursure Cleanup shall not be held liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to: natural disasters, hurricanes, tropical storms, flooding, pandemics, government orders, civil unrest, or other force majeure events.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fursure Cleanup, its owners, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to:

  • Your breach of these Terms
  • Your negligence or willful misconduct
  • Injuries caused by your pets to our staff or third parties
  • Hazardous conditions on your property that you failed to disclose
  • Any inaccurate information you provided to us

13. Intellectual Property

All content on the Fursure Cleanup website — including text, graphics, logos, images, photographs, and software — is the property of Fursure Cleanup or its licensors and is protected by United States copyright and trademark laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our website without our prior written permission. The "Fursure Cleanup" name and logo are trademarks of Fursure Cleanup and may not be used without authorization.

14. User Accounts

If you create an account on our website (customer portal or affiliate dashboard), you are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

15. Dispute Resolution

Good Faith Negotiation

In the event of any dispute arising from these Terms or our services, both parties agree to first attempt to resolve the matter through good faith negotiation by contacting the other party in writing.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Harrison County, Mississippi.

16. General Provisions

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fursure Cleanup with respect to the subject matter herein and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of our website or services after any changes indicates your acceptance of the updated Terms. For material changes that affect active subscriptions, we will provide at least 14 days' written notice.
